What Changed With the 2024 Fee Rule
USCIS implemented a major fee restructuring effective April 1, 2024. Key changes included:
- I-485 fee increased significantly but now includes biometrics and I-765/I-131 fees when filed concurrently
- Biometrics fee ($85) was eliminated as a separate charge — now bundled into form fees
- A new asylum filing fee was introduced for the first time
- Premium processing fee increased to $2,805
- Online filing discounts of $50 were introduced for some forms
Fee Waivers (Form I-912)
If your household income is at or below 150% of the Federal Poverty Guidelines, you may qualify for a fee waiver using Form I-912. Qualifying forms include I-485, N-400, I-765, I-90, and several others. You must provide proof of income such as tax returns, pay stubs, or proof of means-tested benefits.
Not all forms qualify for fee waivers. Notably, I-130, I-140, I-751, and I-907 do not accept fee waivers. There is no workaround for these — the full fee must be paid.
Payment Methods
- Online filing: Credit card, debit card, or bank account (ACH)
- Paper filing: Personal check, cashier's check, money order, or credit card (Form G-1450)
- Make checks payable to "U.S. Department of Homeland Security"
- Do not send cash — USCIS does not accept cash payments by mail
Frequently Asked Questions
How much does a marriage-based green card cost in total?
Filing I-130 ($535) + I-485 ($1,140, includes EAD and AP when filed concurrently) = approximately $1,675 in USCIS fees. Add the medical exam ($200–$500) and passport photos, and the total out-of-pocket cost is typically $1,900–$2,200 without legal representation.
Can I get a refund if my application is denied?
No. USCIS filing fees are non-refundable regardless of the outcome. The fee covers the cost of processing your application, not a guaranteed result. If your application is rejected (not accepted for processing), the fee may be returned.
